§1 General
1. All information and services ("services") provided at hstm-index.de and hstm-index.com ("the websites") are free services. All services are provided on the basis of the present General Terms and Conditions ("GTC"). If any user violates the GTC, his or her permission to use the services can be terminated by the provider.
2. The mere use of the websites does not result in a contractual relationship between the user and the provider. The user does not acquire any ownership or other rights in any services. All free services are provided on a voluntary basis only. Thus, the user cannot have any claim on the constant availability or general functional capability of any certain services. Moreover, the provider has no obligation to waive changes or termination of any information, data or services.
§2 Limitation of Liability
The websites' contents were created with the utmost care and to the best of our knowledge and will be updated regularly. However, in the legal sense all information on the websites is fundamentally non-binding and there are no guarantees for its accuracy or relevance. Prices and availabilities shown on the websites are depending on the providers' database, but are no guarantees too. All contents should not be understood as an investment recommendation. Any liability for damages or losses is excluded.
§3 Copyrights
1. Contents and design of the websites are subject to copyright. They may not be modified, copied, distributed, reproduced, republished, downloaded, displayed or demonstrated, posted, transmitted, or sold in any form or by any means, in whole or in part, without the providers' prior written permission.
2. An explicit exception are the current index value in numbers as well as the chart of the complete index. Both may be published without the written permission as long as the hstm-index.com website is also mentioned as the reference. In this context it is further allowed to use the HSTM logo.
§4 Rights and Obligations of the user
1. The user receives a non-exclusive right to use the websites and services.
2. Some services require to open an account. Providing personal or business data during the registration takes place voluntarily. This data is for internal use only, whereby the user acknowledges and agrees that the provider and his project partners are allowed to contact him by email, mail or telephone as long as their contact relates to the respective purpose. This applies particularly to the so-called "alarm function" and therefore relevant sales offers. See "Privacy Policy" for further details.
3. At any time the user can submit a written request for the cancellation of his registration and his account.
